By applying for the LUMICKS T-shirt competition and providing your original data, you understand and agree that LUMICKS and anyone else acting on behalf of the LUMICKS or its respective licensees, successors, affiliates and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, presented with full accreditation, for news, publicity, advertising, public relations, and promotional purposes without any further compensation, notices, review, or consent.
By applying for the LUMICKS T-shirt competition, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your application and submitted data infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of LUMICKS. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless LUMICKS from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which LUMICKS may incur, suffer, or be required to pay to arise out of such infringement or suspected infringement of any third party’s right.
LUMICKS reserves the right to accept, reject, modify, suspend or cancel any competition participation, where and when deemed necessary, in respect to any violation or potential violation of any Terms and Conditions stipulated herewith.
LUMICKS shall not be liable to any monetary compensation, reimbursement or indemnity arising from any claims, losses, personal injuries, property damages or expenses to any party throughout the duration of and after the said participation.
For any whatsoever reason, where any part of the competition is not capable of being executed as planned by reason of, but not limited to, the infection by computer virus, bugs, tampering, unauthorized interception, fraud, negligence, technical failures or any other causes beyond the control of LUMICKS whereby having corrupted or affected the administration, security, fairness, integrity, or proper conduct of the said competition, LUMICKS reserves the right to exercise its absolute discretion to disqualify any entry and/or cancel, terminate, modify or suspend the competition. LUMICKS in doing so shall not be liable or responsible for any direct or indirect damages thereof.
LUMICKS reserves the right to exercise its absolute discretion to cancel, postpone, suspend, modify or terminate the competition at any time without reason or prior notice.
